%T 美国反海外腐败法的问题与走向<br>Problems and Trend of American Foreign Corrupt Practices Act

%X 美国《反海外腐败法》，作为全球反海外腐败的第一部法律，从其颁布到实施，经历了一个由松到紧的历史过程，一定程度上甚至呈“侵略性”实施的发展趋势。该法在实施过程中暴露出一些问题，其实施缺少司法审查，从而导致对公平与正义的违反，最终与其立法原意背道而驰。美国当局及学界也意识到这些问题，并对其修订与完善进行了诸多探讨。<br>As the first anti-foreign corruption law in the world，American Foreign Corrupt Practices Act has changed from being relaxed to being aggressively enforced.Some problems such as being short of judicial review，being against the fairness and justice and being against the legislative origin have occurred during the enforcement.The American authority and academic circles have been aware of the problems and have discussed a lot about it.
