%0 Journal Article %T “负志”之罪与秦之立法精神<br>The Legislative Spirit of Qin Dynasty as Seen in the Stipulations of Fuzhi %A 于振波 %J 湖南大学报(社会科学版) %D 2015 %X 秦代法令中的“负志”表示怀有志向或坚守节操,“负志”之人试图与当政者保持距离而拒绝入仕,因而受到法律的惩罚。法家是君主专制制度的倡导者和实践者,他们利用人性的弱点为专制君主服务,以“富国强兵”的名义视个人的权益,甚至蔑视个人的人格,秦代相关律令正是法家思想的集中体现。<br>“Fuzhi”means cherishing ambition or sticking to moral integrity in the laws of Qin Dynasty.Those who tried to keep a distance from autorities and refused to enter the official career would be punished.The Legalists were advocators and practitioners of the autocratic monarchy. They exploited human weaknesses for despots, disregarded the rights of individuals, and even despised individual's personality in the name of “enriching the country and increasing its military force”.
