%0 Journal Article %T 对《英国消费者权益法案》中不公平条款机制的剖析<br>Analysis on Unfair Terms in UK Consumer Rights Act %A 齐鹏 %J 西安交通大学学报(社会科学版) %D 2016 %R 10.15896/j.xjtuskxb.201602011 %X 2015年《英国消费者权益法案》整合完善现有相关立法,对消费者合同中不公平条款内容进行详细补充完善,构成了调节销售者与消费者之间法律关系的核心规范;设立扩大了消费者权益法案的适用范围,给予不公平条款的判定标准进一步细化,扩大了“黑名单”“灰名单”的内容,对合同条款免于公平性测试的条件进行规定,并增加了法院主动参与合同条款公平性考量的权利等;同时,也存在部分规则不够完善的遗憾,甚至可能引起对部分制度有效性的质疑;基于此,对此次法案相关规定进行剖析建议,以助其更好完善,为中国相关立法积累经验。<br>The UK Consumer Rights Act 2015 supplements and improves the existing legislation, especially the unfair terms in the consumer contracts, constituting a core specification to regulate the legal relationship between sellers and consumers. The Act has expanded the scope of application, detailed the unfair terms of criteria to expand the "black list", "gray list" content, specified the fairness of the terms of the contract from the test conditions, and increased engagement contract terms Court right to a fair consideration of the like. But it is regretable that part of the rule is not perfect, and it may even lead to questioning the validity of part of the system.
