%X 摘要：广场舞引发了体育权利和安居权利的冲突。指责广场舞者侵犯了居民权利的逻辑，就如同指责居民侵犯了广场舞者权利的逻辑一样，均有失偏颇，不利于权利冲突的消解。为探索合理的治理路径，运用文献资料法、社会调查法等研究方法，对既有的研究成果进行梳理，探究问题的关键，扩展新的研究视角。广场舞与侵权之间并无必然的逻辑联系，权利冲突既源于存量资源的错配，也与增量资源的供给不足相关。由国家规制权利冲突，应考量私权主体之间的交易成本和资源配置社会效用的最大化，促进意思自治下的权利交易。有鉴于此，针对权利冲突，提出正确舆论引导和公共精神培养相结合、交易优先和规制辅助相结合、存量资源分配与增量资源供给相结合、立法规制与行政治理相结合等治理措施，以期能为广场舞纠纷的化解提供些许有益指导。<br>Abstract: Square dance triggered the conflict between sports rights and right to live. The logic of accusing square dancers of infringing on residents'rights is just like that of accusing residents of infringing on square dancers' rights, which is biased and not conducive to the resolution of rights conflicts. In order to explore a reasonable way of governance, this paper combs the existing research results, explores the key issues and expands the new research perspective by using the methods of documentation and social investigation. There is no logical connection between square dance and infringement. The conflict of rights is not only due to the misallocation of stock resources, but also related to the insufficient supply of incremental resources. In order to regulate the conflict of rights, the state should consider the transaction cost and maximize the social utility of resource allocation between private rights subjects, and promote the right transaction under the autonomy of the will. In view of the conflict of rights, this paper puts forward some governance measures, such as the combination of correct public opinion guidance and public spirit training, the combination of transaction priority and regulation assistance, the combination of stock resource allocation and incremental resource supply, and the combination of legislative regulation and administrative management. This paper hopes to provide some useful guidance for the settlement of square dance disputes
