%T 《体育法》修改中增加体育产业章节的研究<br>Adding Sports Industry Chapter in Amendment of China’s Sports Law

%X 摘要：社会主义市场经济本质上是法治经济。体育产业的发展需要法治的保障。十八届四中全会对依法治国战略的全面推进和国务院46号文件对中国体育产业发展的部署，都对中国体育法治建设提出了新的要求。作为体育领域的基本法，《体育法》修改一直是近年来中国体育法治建设过程中的一项重要任务。在国家推进依法治国战略和发展体育产业的双重合力之下，《体育法》修改显得更为迫切。采用文献资料法、比较法、案例分析等方法就《体育法》修改中增加体育产业章节进行了探讨。研究认为：《体育法》修改过程中应该新增体育产业章节，就体育产业中体育产业的概念、政府与市场的关系，职业体育，体育无形资产保护，大众体育产业等相关方面的问题以专章的形式加以规定，为落实国家在体育产业领域的战略部署，促进体育产业的发展提供法律上的保障。<br>Abstract: The essence of socialist market economy is economic governed by law. The development of sports industry needs the guarantee of law. Rule of law strategy promotion past by the Fourth Plenary Session of the Eighteenth Central Committee of the Communist Party of China and sports industry development deployed in No. 46 Document of the State Council in 2014 have new requirements to China sports legal construction. As the basic law of sports, amending Sports Law is an important task in recent years’ China sports legal construction. In the background of rule of law strategy and sports industry development, amending Sports Law is an urgent necessary. This paper analyzed adding sports industry chapter into Sports Law by the methods of literature review, comparative analysis, and case study. The results showed that sports industry chapter should add into Sports Law. Its definition, the relationship between government and market, professional sports, sports intangible asset protection, and mass sports industry should be included in the chapter. It will be beneficial for carrying out government’s strategy on sports industry and providing legal protection to it
