%X 摘 要： 赔偿影响量刑是基于司法现实的迫切要求，这符合量刑的本质，有着积极的刑事政策意义。赔偿影响定罪是由犯罪的本质所决定的，也是辩证式定罪方法的必然要求，同样能够实现报应与预防的效果。赔偿影响行刑符合刑罚执行的目的，符合刑罚执行的经济性原则，还可以满足司法实践的现实需求。赔偿能否对刑事责任产生积极影响，既取决于司法上对法律的准确理解，也依赖于立法上对法律的合理完善。<br>Abstract: The influence of compensation on sentencing, based on the urgent need of the judicial reality, conforms to the nature of sentencing and bears positive significance in criminal policy. The influence of compensation on convection is determined by the nature of crime and required by the dialectical method of conviction. Furthermore, it can reach the goal of retribution and prevention. The influence of compensation on execution is consistent with not only the purpose of execution but also the requirement and economic principles of penalty execution. It can also achieve the realistic requirement of judicial practice. Whether or not compensation has a positive impact on criminal responsibility depends on the accurate understanding and the legislation improvement of the law
