%X 传统中国不仅有自成体系的法律之学，亦有逻辑自洽的法理。以儒家经义为重要渊源和依据，以实现儒家政治理想作为立法宗旨与目的，是传统中国法理最为显著的特点。具体而言，《唐律疏议》中含有类似于西方法学意义上的法律概念、法律规则与法律原则等要素，这些要素在实践中发挥着重要功效。“君亲无将，将而必诛”、“礼不下庶人，刑不上大夫”以及“讲信修睦”是《唐律疏议》中处理好国家君主与臣民、官僚与民众以及民众内部关系的基本法理。传统中国法理是祖先留给我们的智慧宝库，对其内容进行全面梳理，能够增强我们的民族自信，提升我们在国际交往活动中的话语权。传统中国法理与现代法理的结合，将为当代法律体系的修订与完善提供新思路。</br>Traditional China not only has its own legal system, but also has its own Fali with logical consistency.It is the most significant feature of traditional Chinese Fali that Confucian Classics are the important sources,and realizing Confucian political ideal is the purpose of legislation.Specifically,there are some elements such as legal concepts,legal rules and legal principles,which are similar to western jurisprudence,and these elements also play an important role in practice.The basic Fali of dealing with the relationships between the state monarch and subjects,bureaucrats and the people, and the people in Tang Lu Shu Yi is that “Being loyal to the sovereign, or will be killed”,“Rites do not extend to the common people and the punishment is not up to the doctor”and“Having faith and promoting good will”.The traditional Chinese Fali is a treasure house of wisdom left to us by our ancestors.A comprehensive review of its contents can enhance our national confidence and our discourse power in international communication activities.The combination of traditional Chinese Fali and modern Fali will provide new ideas for the revision and perfection of the contemporary legal system.
