%X 法理是法理学的中心主题，但长期以来，许多法理学著述其实是没有法理的法学学。张文显教授的长文《法理：法理学的中心主题和法学的共同关注》发表以来，在法学界引发了广泛的关注和深入的讨论。就深入开展法理研究，张文显教授提出的基本问题达19项之多，其中最关键的问题是如何提炼法理。这是法理学的中心任务和主要困难。只有提炼法理、体现法理、具有法理之后，法理学才能成为名副其实的法理学，才能真正转型升级。提炼法理需要一定的方法和路径，这些方法和路径主要包括概括、思想（理论）、思辨批判、分析、体系化和金句表达。</br>Fali is the central theme in jurisprudence, but for a long time, many jurisprudential writings are the general theory about legal science without Fali. Professor Zhang Wenxian’s article,“Fali: the Central Theme in Jurisprudence and the Common Concerns of Chinese Legal Science”, in the law field has caused widespread concern and in-depth discussion. In order to carry out the study of jurisprudence in depth, there are 19 basic questions put forward by Professor Zhang Wenxian, of which the most important problem is how to refine Fali. This is the central task and main difficulty of jurisprudence. Only after the refinement of Fali, the embodiment of Fali and the possession of Fali,can the jurisprudence be worthy of the name, and can the transformation and upgrading of jurisprudence be realized. There are some ways and paths to refine jurisprudence, and they mainly include generalization, thought (theorization), speculative criticism, analysis, systematization and golden sentence expression.
