%X 新发展理念作为对经济社会发展规律的新认识，引领着法治中国的建设。如何理解“引领”，则是整个命题的核心。“市场经济就是法治经济”、“公共秩序和公共利益维护的目标统一”、“‘以人民为中心’与‘权利保障’的价值趋同”三个方面的逻辑连接点，为“引领”提供了可能性。在具体的方法论上，借助法律价值的媒介作用、法律适用中的解释和论证中的修辞两条路径，是实现“引领”比较适当的方案。在通过方案实现“引领”的同时，也需要警惕政治替代和倾轧法律的倾向，使新发展理念亦受到法治话语的拘束和规范，这完全符合中央强调的“运用法治思维和法治方式深化改革、推动发展、化解矛盾、维护稳定”的政治要求，是对法治规律的一种遵循。</br>As a new understanding of the law of economic and social development, the new idea of development is leading the construction of the rule of law in China. However, the core of this proposition is to understand the word of “leading”. The logic connection of “market economy under the rule of law”, “uniform objective between public order and public interest” and “the value convergence of ‘people-centered’ and ‘right-guarantee’” is aprobable answer. On the method of research, the media role of legal value and the rhetoric of interpretation and argument in the application of law arethe comparatively suitable way. At the same time, we need to be vigilant about the tendency of political substitution and suppressing the law, so that the new idea of development is also restrained and regulated by the rule of law. This is fully in line with the political needs of “deepening reform, promoting development, resolving contradictions and maintaining stabilityby using the thinking and way of the rule of law”. It is also in accordance with the law of the rule of law.
