%0 Journal Article %T 作为政治概念的法治文化:内在张力与规范诉求 %A 杨 %A 建 %J 法制与社会发展 %D 2018 %X 学界对法治文化的研究总体上延续了结构主义的进路,这一进路不需要追问和回答法治文化作为一个独立的概念有无内在张力的问题。但对这个问题的回答其实非常必要。面对这个问题,解构法治的苏力进路以及解构文化的新法家进路都失败了,一个更能被证立的理解是将法治文化界定为政治概念。作为政治概念的法治文化,它的基本含义是指党和政府向全体国民作出了一个将法治融入我们的生活方式和价值观念的承诺。基于此,法治文化概念必然预设了政治合法性的再认识命题、法治实现的可能性命题以及法治建设的文化生成路径命题。</br>The current studies on the culture of the rule of law are dominated by what might be called a structuralist framework. However, the structuralist framework miss the question of whether or not the culture of the rule of law as an independent academic concept has inherent tensions. This is a question of great theoretical importance. The existing two main approaches have denied the inherent tensions exemplified by the Suli and the Neo-Legalist approach, and are doomed to fail. A more promising approach is to treat the culture of the rule of law as a political concept, which manifests the commitment the CCP and government make to all citizens that the state is determined to make the rule of law an integral part of the way we live and common values.
