%0 Journal Article %T 财产权的两重性与住宅建设用地使用权续期的制度安排 %A 朱 %A 振 %J 法制与社会发展 %D 2017 %X 目前住宅建设用地使用权续期收费问题的困境在于土地的市场化与土地的公有制之间的协调,重新市场化式收费在本质上是反市场的,也并不必然体现公有制。财产权既具有个人性,也具有公共性。个人性意味着要高度重视个人财产权即个人财产自由的重要性,公共性意味着要从个人财产权中剥离出与社会主义公有制的分配伦理相适应的财产权之社会义务面向,由各级政府代表国家对这一部分重新进行合理分配。除了市场价值,住宅还肩负着基本人权的功能。居住是基本权利,住宅并非单纯作为交易、增值的一种手段,因此这部分房产是不能加以社会化的。世界各国普遍采取税收体制来体现财产权的社会义务面向。在对财产权的保护上,西方国家是由过于强调个人逐步过渡到个人与社会的平衡;而我国在土地财产权之个人/社会/国家之关系上应着重强调一种反向的平衡,更加注重对个人财产权的保护。</br>Now the dilemma of renewal fees about the usage rights of residential construction land lies in the coordination between market and public ownership of land, charging in a market-oriented manner in essence is anti-market, and it does not necessarily reflect the public ownership. In addition to the market value, the dwelling also bears the basic human rights functions. Dwelling is the basic right, the dwelling is not simply as a means of value-added by transactions, so this part of the property can not be socialized. Generally all countries in the world have adopted the tax system to reflect the social obligation of property rights.
