%0 Journal Article %T “城市的土地属于国家所有”释论 %A 孙煜华 %J 法制与社会发展 %D 2017 %X “城市的土地属于国家所有”是附条件的义务性规范,义务是城市的土地国有化。实现义务的条件是:纳入城市范围、国家为了公共利益依法有偿征收。按宪法原旨,“城市”应解释为“直辖市、设区的市中的城区及不设区的市”。“国家所有权”是宪法和物权法上的所有权。依照“城市土地应当属于国有”的解释及对公共利益的广义解释,“征地悖论”可以被化解。未依法有偿征收的土地不能国有化,所以城中村的土地在被征收之前,属于农村集体所有,应当按照宪法的规定区别对待城中村。城中村中符合征收条件的土地不宜直接入市,可以入市的主要为城区外的城郊及农村的土地,撤县设区不能直接带来土地权属的改变。</br>“Land in the cities is owned by the state” is a conditional obligatory article. The government should make a distinction between different lands in the urban village. The lands in the urban villages can not enter to the land markets if they can be acquired by the government for the public interests. The lands in suburbs or countrysides out of the urban planning can enter to the land markets.
