%X ？becauseofitscommitmenttokeepingthedigitalcontentsaccessible,institutionalrepositoryplaysanimportantroleinthelong-termpreservationofintellectualoutputoftheinstitution.however,digitalpreservationininstitutionalrepositoryisfacedwithseverelegalissues,especiallytheintellectualpropertyproblems.thispaperfocusesonthecopyrightissuesinvolvedwithlong-termpreservationofdigitalresourceininstitutionalrepositories.itbeginswithabriefintroductiontotherelationshipbetweentheinstitutionalrepositoryanddigitalpreservation.basedonthisbackgroundinformation,thepaperanalyzestherelatedlawsandregulationsinchinathataffectthelong-termpreservationofdigitalresourceininstitutionalrepository.thentheauthorsdiscussindetailswhatkindofthecopyrightrisktheremaybe,ifwerealizethelong-termpreservationofdigitalresourceininstitutionalrepositories.theremaybedifferentlegalhazards,accordingtothevarioustypesofthedigitaloutputcollectedbyinstitutionalrepository.thepaperendsupwithseveralsuggestionstoavoidthelegalriskindigitalpreservationofinstitutionalrepository.firstly,toutilizefairuseisafeasibleway.secondly,alsomostsafely,istogetthepermissionfromthecopyrightowner.thisisinvolvedinthelong-termpreservationcontractandopenlicense.
