%T Le droit d¡¯initiative du sultan et les lois de Fatih (Mehmed II)

%X Un syst¨¨me juridique bas¨¦ sur la coutume et la volont¨¦ du sultan compl¨¨te ¨¤ partir du XIVe si¨¨cle la char 'a, affirmant la force de la tradition turco-mongole.En d¨¦pit du caract¨¨re religieux de l¡¯Empire ottoman, un syst¨¨me juridique s¨¦culaire bas¨¦ sur la coutume et ¨¦tabli par la seule volont¨¦ du souverain se d¨¦veloppe notamment ¨¤ partir du XIVe si¨¨cle, s¡¯octroyant une place significative aux c t¨¦s de la jurisprudence islamique. Les lois relatives ¨¤ ce droit coutumier, rentrant parfois en conflit avec la char 'a, sont d¡¯une certaine fa on li¨¦es ¨¤ la tradition turco-mongole, constituant ainsi une preuve incontestable de la place absolue et centrale qu¡¯occupe le souverain dans la conception de l¡¯Etat au sein des organisations turco-islamiques. Despite the religious nature of the Ottoman Empire, a secular legal system based upon social customs, established by the sovereign, developed mainly from the 14th century, eventually taking a place of significant importance alongside Islamic Law. The rules relating to this kind of law, - that may in some cases contradict the principles of the Chari¡¯a-, are somehow associated with Turkish and Mongol traditions, therefore constituting undeniable evidence asserting the absolute and central position of the sovereign in Turkish-Islamic organization¡¯s traditional conception of the state.
