%X RESUMO A extradi  o, juntamente com a expuls o e a deporta  o, ¨¦ uma medida de exclus o de estrangeiros, fundamentada em Tratado ou, na aus¨ºncia deste, em promessa de reciprocidade. O presente artigo trata, especificamente, da extradi  o do italiano Cesare Battisti, at¨¦ hoje sem um desfecho no Supremo Tribunal Federal, pelo fato de que, autorizada pela Suprema Corte e negada pelo ent o Presidente da Rep¨²blica, Luiz In¨¢cio Lula da Silva, o pedido retornou ¨¤quele Tribunal para decis o final. O presente estudo n o busca prever o resultado final dessa celeuma, mas analisa os fatos que levar o a um final que pode mudar todo o entendimento referente a extradi  o passiva no Brasil. THE FEDERAL SUPREME COURT, THE PRESIDENT AND EXTRADITION OF CESARE BATTISTI ABSTRACT The extradition, along with the expulsion and deportation, is a measure of exclusion of foreigners, based on treaty or, failing that, on the promise of reciprocity. This article deals specifically for extradition of Italian Cesare Battisti, so far without an outcome in the Supreme Court, by the fact that authorized by the Supreme Court and denied by the then President of the Republic, Luiz Inacio Lula da Silva, the request returned Criminal Court for final decision. This study does not seek to predict the final outcome of this uproar, but analyzes the events that lead to an end that can change the entire understanding regarding passive extradition in Brazil.
