%X La decisi車n de abordar normativamente las uniones de hecho supone resolver previamente una serie de cuestiones. Entre ellas, la de si el r谷gimen personal -derechos y obligaciones que se refieren o tienen por objeto a las personas mismas que integran la pareja- debe ser regulada por el legislador. En este trabajo, y bajo la premisa que en Chile se optara por conferir a las uniones de hecho heterosexuales un estatuto legal propio, se muestra c車mo las escasas leyes que han regulado aspectos espec赤ficos de las uniones de hecho han situado correctamente a esta instituci車n en el derecho de familia, a diferencia de la perspectiva utilizada por el r谷gimen jurisprudencial aplicable a los aspectos patrimoniales de las mismas. Se intenta establecer las consecuencias que este cambio puede acarrear y se justifica la tesis de la conveniencia de no fijar legalmente un r谷gimen personal para los convivientes en atenci車n al marco prove赤do, en general, por los derechos fundamentales reconocidos por la Constituci車n. Before the decision to regulate cohabitation can be taken, a series of questions must be addressed. Among them, whether non economic familial effects -rights and obligations between partners- should be regulated by law. This paper,assuming that Chile will confer legal status to heterosexual co-habitation unions, will show how the few existing laws regulating specific personal aspects of co-habitation have correctly situated this status within family law, in contrast to the perspective adopted by the judiciary regarding economic aspects of this kind of partnership. This paper aims to outline the consequences this shift would bring and argues against the legal regulation of non-economic familial effects for co-habitants, taking into consideration the fundamental rights guaranteed by the Constitution.
