%X Por meio de pesquisa realizada sobre a cria  o e a consolida  o dos Conselhos Municipais de Educa  o (CMEs) no Estado de Minas Gerais, esse artigo demonstra que h¨¢ elementos presentes nos atos normativos de cria  o dos CMEs mineiros que revelam imprecis es quanto ¨¤ defini  o da natureza, da fun  o e da compet¨ºncia de tais conselhos. Tais imprecis es contribuem para indefini  es sobre a atua  o desses ¨®rg os no que se refere ¨¤ gest o colegiada das pol¨ªticas educacionais municipais. Ao n o estabelecer regras claras para a constitui  o dos CMEs, remetendo para a arena pol¨ªtica a afirma  o da sua natureza, o executivo municipal formaliza juridicamente a sua exist¨ºncia mas pode esvaziar as suas possibilidades reais de atua  o. Acrescenta-se ainda que os dados consultados revelaram, por diversas vezes, contradi  o entre as compet¨ºncias (in)definidas, as fun  es e a natureza atribu¨ªdas aos CMEs. Through research on the creation and consolidation of the Local Boards of Education (CMEs) in the State of Minas Gerais, this article intends to show that the vagueness of normative acts to create CMEs in the State of Minas Gerais contributes to uncertainties about the performance of these bodies regarding the collegial management of municipal education policies. By failing to establish clear rules for the formation of CMEs, referring the assertion of their nature to the political arena, the municipal executive power legally formalizes their existence, but can undermine their real possibilities of action. Moreover, the data have revealed, on several occasions, that there is contradiction between the (un)defined powers, the functions and the nature assigned to the CMEs.
