Bien que Fran ais, ils ne rel¨¨vent pas du statut personnel de droit commun. Ce statut coutumier a des cons¨¦quences autant sur la norme applicable ¨¤ leur situation qu¡¯¨¤ la composition de la juridiction. Si cette s¨¦paration statutaire doit conduire ¨¤ diff¨¦rencier les deux types de sources lors de leur interpr¨¦tation et application, il appara t que la Cour de cassation comme la loi organique de 1999 d¨¦terminent le champ d¡¯application ratione person et materi de la coutume sous le prisme du droit commun. Or, il n¡¯est pas certain que cette d¨¦marche, consacr¨¦e, soit pertinente alors que l¡¯¨¦galit¨¦ entre le droit commun et la coutume est conditionn¨¦e par celle, constitutionnelle, des statuts. Il conviendra alors de poser les pr¨¦misses d¡¯une critique de cette approche positiviste de la coutume et du statut civil coutumier, ¨¤ l¡¯aune de questions pos¨¦es par la rencontre des deux statuts, notamment la qualification des notions qui en d¨¦limitent le domaine. In New Caledonia, Kanak can, under the terms of article 75 of the Constitution, preserve their usual personal status. Although French, they do not belong to the personal status of Civil Law.
