The loss of species and reduction of genetic variation are direct and/or indirect consequences of human actions such as deforestation, urban sprawl, burning fossil fuels, among others. Starting from the idea that the royalties make up a financial compensation whose genesis is the promotion of intergenerational justice, we performed an analysis of the legal framework in place to determine the compatibility of these resources with the protection of biodiversity. We notice that there is a gap in ownership of intergenerational perspective, constitutionally established, both along the legislative process and practice of related public policy.
