Elle fournit ainsi une grille de lecture op¨¦ratoire pour caract¨¦riser l¡¯¨¦volution de la politique criminelle en France. On peut alors consid¨¦rer que la loi du 25 f¨¦vrier 2008 sur la r¨¦tention de suret¨¦, expression n¨¦olib¨¦rale de l¡¯utilitarisme p¨¦nal contemporain, rel¨¨ve moins d¡¯une rationalit¨¦ juridique que d¡¯une rationalit¨¦ ¨¦conomique. De ce point de vue, elle proc¨¨de donc moins de l¡¯utilitarisme de Beccaria que de celui de Bentham. A Foucaldian genealogy of European utilitarianism casts light on the motives of the new art of ruling that emerged in the eighteenth century, and under which we still live today, maybe more than ever. Therefore, it supplies an operating perspective to characterize the evolution of the French criminal policy. The Security detention law of February 25, 2008, the neoliberal expression of contemporary criminal utilitarianism, can then be considered as the product of economic rationality, rather than of legal rationality. As such, it derives less from Beccaria¡¯s utilitarianism than from Bentham¡¯s. %U http://etudes-benthamiennes.revues.org/292
