%X Esta pesquisa tem o objetivo de enquadrar o Direito de Autor quanto ¨¤ sua natureza jur¨ªdica, baseadona estrutura te¨®rica oferecida pelas doutrinas, ao longo do tempo, com a contribui  o de sistematizar todas as teoriassobre o tema. Qual ¨¦ o comportamento do conte¨²do do Direito de Autor no direito de exclusivo, sem perder de vistaa pol¨ªtica adotada pelas teorias, descrevendo-as. Para isto, foi necess¨¢rio balizar o presente estudo com a an¨¢lise,tanto jusfilos¨®fica, quanto dogm¨¢tica, da doutrina, a legisla  o e jurisprud¨ºncia. Na metodologia, utiliza-se dosprocessos de an¨¢lise, sint¨¦tica e anal¨ªtica. Tamb¨¦m, dial¨¦tico, indutivo e dedutivo, quando a vertente e necessidadete¨®rica e t¨¦cnica se mostrar adequada. Espera-se que seja uma contribui  o para o desenvolvimento cient¨ªfico.This source has the objective to fit the Copyright how much to its legal nature, based in thetheoretical structure offered by the doctrines, to the long one of the time with contribution of systematic all theoriesabout the theme. This is the behavior of the content of the Copyright in the right of exclusive, without losing of sightthe politics adopted for the theories, describing them. For this, it was necessary to mark out with buoys the presentstudy with the analysis, in such a way jusphilosophy, how much dogmatic, of the doctrine, the legislation andjurisprudence. In the methodology, it is used of the processes of analysis, synthetic and analytical. Also, dialectic,inductive and deductive, when the source and theoretical necessity and technique if show adequate. One expects thatit is a contribution for the scientific development.
