%0 Journal Article %T La administraci車n de territorios: del protectorado a la administraci車n territorial internacional | The Administration of Territories: from the Protectorate to the International Territorial Administration %A 芍ngel RODRIGO %J Relaciones Internacionales %D 2009 %I Universidad Aut車noma de Madrid %X El objetivo de este trabajo es examinar la evoluci車n institucional de la administraci車n de territorios por terceros distintos del estado territorial y, en particular, profundizar en la distinci車n entre dos modalidades de la misma: el protectorado y la administraci車n territorial internacional. La tesis que se defiende es que, aunque la administraci車n territorial internacional tiene algunas similitudes con el protectorado internacional, son instituciones diferentes porque tienen objetivos distintos, el fundamento jur赤dico no es el mismo, operan en otro contexto y tienen exigencias de legalidad, legitimidad y eficacia internacionales distintas en su aplicaci車n pr芍ctica. En s赤ntesis, el protectorado, en sus diversas versiones, era un instrumento al servicio de los intereses estrat谷gicos, econ車micos o militares de las grandes potencias; era una instituci車n m芍s para la formalizaci車n jur赤dica de relaciones jer芍rquicas de hecho entre estados o entidades. Por contra, la administraci車n internacional de territorios, en la actualidad, es una herramienta que, fundamentalmente, se utiliza para la protecci車n de valores e intereses generales de la comunidad internacional como la paz y los derechos humanos fundamentales. The object of this paper is to analyze the institutional evolution of the administration of territories conducted by third parties different from the territorial state and, more precisely, to deepen in the distinction between two of its forms: the protectorate and the international territorial administration. Although these two forms share some similarities, the main thesis is that the international protectorate and the international territorial administration constitute two different institutions. That is because they have different goals, they are based on two distinct legal foundations, they operate in different contexts and they each entrain different requirements for international legality, legitimacy and efficacy in their implementation. The protectorate, in its various forms, was used as an instrument serving the strategic, economic and military interests of the great powers; it was one of many institutions used to formalize, in legal terms, the de facto hierarchical relations among states or political entities.
