%X Neste artigo, enquadrado numa investiga  o mais ampla na ¨¢rea da psicologia, que envolve imput¨¢veis e inimput¨¢veis, realizada num estabelecimento prisional em Portugal, pretendemos fazer uma breve revis o bibliogr¨¢fica sobre a utilidade ea importancia do consentimento informado na pesquisa, quer com cidad os livres, quer com cidad os juridicamente privados de liberdade. Consideramos que todo o profissional de sa¨²de, nomeadamente psic¨®logo, deve pugnar pela obedi¨ºncia a firmes padr es de ¨¦tica nas investiga  es, independentemente do grupo que esteja a estudar. Come amos por definir as no  es de de ontologia e ¨¦tica, e depois nos debru amos sobre os princ¨ªpios ¨¦ticos contemplados no ordenamento jur¨ªdico portugu¨ºs sobre o consentimento informado, entre os quais o respeito pela dignidade da pessoa, a compet¨ºncia, a responsabilidade e a benefic¨ºncia e n o mal efic¨ºncia. In this paper, framed in a broader research in the field of psychology that involves able-to-stand-trial and not-guilty-by-reason-of-insanity in a prison in Portugal, we intend to briefly review the literature on the usefulness and importance of informed consent in research with free citizens and with citizens legally deprived of freedom. We believe that all health professionals, namely psychologists, should strive for compliance with firm standards of ethics in research, regardless of the group being studied. We begin, then, define the concepts of deontology and ethics, and then turning to the ethical principles covered in the portuguese legal informed consent, including respect for human dignity, competence, responsibility and kindness and not nonmaleficence. Within this framework, we discuss issues that arise when citizens informed consent in legally deprived of their liberty: and attributable indictment.
