%X Resumo: No presente artigo se abordar¨¢ o processo migrat¨®rio no Continente Americano com enfoque especial ao Estado brasileiro. O fen meno da migra  o n o ¨¦ recente na hist¨®ria humana, por¨¦m vem se vivenciando um paradoxo cada vez mais evidente no qual o direito internacional prega a prote  o aos direitos humanos no processo de migra  o e os Estados soberanos se utilizam de suas normas para a sua prote  o e seguran a nacional, colocando em xeque os direitos inerentes a pessoa humana.   Palavras-chave: Migra  o Internacional, Direitos Humanos, Seguran a Nacional.     Abstract: In the present article will treat the process of migration in the American continent with special focus on the Brazilian State. The phenomenon of the migration is not recent in the human history however has been experiencing  a contradiction increasingly evident in which the international right preaches the protection to the human rights in this process of migration and the sovereign States use of his norms for his protection and national security, endangering the rights inherent to the human person.
