%X Frente a la sensaci車n de un clima de impunidad relativo a las flagrantes, masivas y sistem芍ticas violaciones al derecho internacional humanitario (DIH), surge enseguida la pregunta de qu谷 hacer para hacer menos gravosa la condici車n de las v赤ctimas. Muchas veces se piensa en sancionar a los autores de dichas infracciones, cuando en realidad el problema es mucho m芍s complejo. En nuestro sentir, sin desconocer el papel que juega la sanci車n en todo ordenamiento jur赤dico, es en la prevenci車n del delito donde se encuentran las mayores dificultades para garantizar el respeto del DIH. Es precisamente hacia all芍 a donde apuntan nuestras reflexiones. En tal sentido, nos proponemos abordar, antes que nada, el alcance y contenido de la obligaci車n -no como un simple deber- de prevenir las violaciones o infracciones al DIH. No ser芍 sino en una segunda instancia que estudiaremos las obligaciones que tiene el Estado espec赤ficamente en esta materia. Finalmente, abordaremos la cuesti車n de las obligaciones relativas a la conducci車n de hostilidades y al derecho operacional en particular, por ser all赤 donde la norma encuentra su principal reto. When facing a climate sensation of impunity concerning flagrant, massive and systematic violations of International Humanitarian Law (IHL), the question arises of what to do to make less burdensome the condition of the victims. Frequently, one thinks of punishing the perpetrators of these violations, when in fact the problem is much more complex. In our opinion, without prejudice to the role played by legal sanctions, is the prevention of the crime where the greatest difficulties appear to guarantee the respect for the IHL. It is precisely where our reflections point. In this regard, we intend to address the scope and content of the obligation -not simply as a duty- to prevent violations or breaches of IHL. But it will be in a second instance where we will approach the obligations of the State specifically in this area. Finally, we will address the question of the obligations regarding to the conduct of hostilities and operational law, in particular; because it is there where the legal regulations find its biggest challenge.
