%X El presente art¨ªculo da cuenta de los resultados de la investigaci¨®n desarrollada en el marco de la Maestr¨ªa en Investigaci¨®n psicoanal¨ªtica, denominada El olvido por lo infantil en la ficci¨®n jur¨ªdica del ni o: lectura de las legislaciones de protecci¨®n a la infancia. La motivaci¨®n por la tem¨¢tica en cuesti¨®n obedece a una sospecha: la existencia de una discordancia entre la idea de ni o promulgada por el discurso jur¨ªdico y lo que la realidad denuncia acerca de la infancia a trav¨¦s de diversos fen¨®menos sociales que emergen con fuerza cada vez mayor en nuestras sociedades contempor¨¢neas. Dicha sospecha se va configurando de manera m¨¢s clara al interrogar al discurso jur¨ªdico por la noci¨®n de ni o implicada en las legislaciones de protecci¨®n a la infancia m¨¢s representativas de nuestra ¨¦poca, teniendo en el horizonte las diversas formas como el Otro social ha tomado al ni o en distintos momentos de la cultura; pero a¨²n m¨¢s, cuando de la mano de la teor¨ªa psicoanal¨ªtica se sit¨²an las nociones y conceptos que permiten pensar lo infantil como aquello que, justamente, es negado tanto en el ¨¢mbito del discurso jur¨ªdico como en el del discurso social de nuestro tiempo. // This article accounts for the research s results developed at the frame of the Master in Psychoanalytic Research called The oblivion for the childish in the legal fiction of the child: Legislation readings of childhood protection. The motivation for this subject obeys a suspicion: The existence of a conflict between the child ideas divulged for the legal discourse and denounces made by the reality about the childhood through various social phenomenon emerging more and more powerfully in our contemporary societies. Said suspicion is shaping clearer when the legal discourse is questioned by child notion involved in the legislation of protection to the childhood more representatives of our time. Taking into account various forms where the social Other has been incorporated with the child at different cultural moments, but much more, when the psychoanalytical theory s notions and concepts take place, it allows us to think similarly to the imaginary infantile as it is justly denied in legal discourse environment as well as in the social discourse of our time
