%X [R¨¦sum¨¦]:L¡¯auteur commente les deux arr¨ºts Whirlpool et Free World Trust dans lesquels la Cour supr¨ºme du Canada a adopt¨¦ le principe de l¡¯interpr¨¦tation t¨¦l¨¦ologique des revendications des brevets, qui supprime l¡¯interpr¨¦tation purement textuelle mais qui resserre l¡¯interpr¨¦tation de ce qui constitue l¡¯  essentiel   ou la   substance   de l¡¯invention. L¡¯auteur critique la solution de la Cour, dans la mesure o¨´ l¡¯adoption de r¨¨gles rigides d¡¯interpr¨¦tation ou m¨ºme l¡¯¨¦nonc¨¦ plus d¨¦taill¨¦ des principes ou des m¨¦thodes d¡¯interpr¨¦tation ne peut diminuer l¡¯incertitude juridique li¨¦e ¨¤ l¡¯interpr¨¦tation des revendications. La solution aurait d  ¨ºtre qu¡¯il faut d¨¦gager l¡¯intention de l¡¯auteur de l¡¯¨¦crit, en ayant recours au sens des mots, au contexte dans lequel ils sont employ¨¦s, ¨¤ l¡¯objet ou ¨¤ la fonction du texte ¨¤ analyser. Il ne s¡¯agit ni d¡¯¨¦carter ni de privil¨¦gier une m¨¦thode, mais plut t d¡¯utiliser les m¨¦thodes les plus appropri¨¦es afin de donner ¨¤ l¡¯¨¦crit une interpr¨¦tation juste et raisonnable eu ¨¦gard aux circonstances.***** [Abstract] The author comments two cases, Whirlpool and Free World Trust, where the Supreme Court of Canada adopted the purposive construction of patent claims, which suppresses the purely textual interpretation, strengthening however the interpretation regarding the essence and substance of an invention. The author criticizes the Court¡¯s solution, indicating that the use of more rigorous rules of construction or the formulation of more detailed principles or methods of construction cannot reduce the legal uncertainty associated with the construction of such claims. Ideally, the solution would have been to determine the author¡¯s intent, based on the meaning of the words, the context in which the words were used and the object or purpose of the text under scrutiny. The aim is neither to reject nor to prefer a method, but rather to use all appropriate methods to interpret a text in a just and reasonable manner, given the particular circumstances of a case.
