%X Resumo: Procedeu-se a uma cr¨ªtica ¨¤ teoria dos fatos institucionais desenvolvida pelo fil¨®sofo JOHN SEARLE, alegando que malgrado seus aspectos l¨®gicos, os chamados fatos institucionais devem ser entendidos como unidades funcionais, tendo em vista a relevancia de seus aspectos pragm¨¢ticos.   Abstract: Critical assumptions are explored with reference to John Searle`s institutional theory, arguing that notwithstanding their logical structure, the institutions should be understood like  functional unities, by reason of  importance of their pragmatic aspects.
