%X The text analyzes the ineligibility of candidates who have been convicted by a judgment not final. The starting point is the art. 14, ¡ì 9, of the Constitution, which requires consideration of the life history of the candidate for the exercise of their mandate. The jurisdiction of the Supreme Court and the TSE busied himself this issue, adopting a weak judicial control. Such positioning drove the passage of the law that governs the popular theme. The ineligibility 'for plug dirty' was regarded as a restriction on the fundamental right of eligibility and how to demand continuation of representative democracy. O texto analisa a inelegibilidade de candidatos que foram condenados por senten a n o transitada em julgado. O ponto de partida ¨¦ o art. 14, ¡ì9o, da Constitui  o, que exige a considera  o da vida pregressa do candidato para o exerc¨ªcio do mandato. A jurisdi  o do STF e do TSE se ocupou dessa quest o, adotando um controle judicial fraco. Tal posicionamento impulsionou a aprova  o da lei popular que disciplina o tema. A inelegibilidade   por ficha suja   foi considerada como uma restri  o ao direito fundamental de elegibilidade e como demanda para continua  o da democracia representativa.
