%X This paper aims to understand how there is the formation of the rights and duties of children and adolescents, comparing the case law and family perception of the needs of children and young people. Being the north point of this essay: withdraw the wide combination of possibilities that the theme suggests, an approximation of how state intervention occurs within the family, case will apply the said Act Spanking. From there then analyze the possible degree of respectability of the law and how it would change the daily family life. The methodology used for this test was the examination of the legal rule; texts that discuss the matter but that are not necessarily legal, research development grounded in interviews with education and law professionals and law and application of questionnaires to residents of Rio. As a result of this study were formulated analysis frameworks of understanding of the subject population and their degree of acceptance and respectability possible. Neste texto objetiva-se compreender como ocorre a forma  o dos direitos e deveres da crian a e do adolescente, confrontando a jurisprud¨ºncia e a percep  o familiar das necessidades infanto-juvenis. Sendo o ponto norteador deste ensaio: retirar, da ampla combina  o de possibilidades que o tema sugere, uma aproxima  o de como a interven  o do Estado se d¨¢ no ambito familiar, caso venha a vigorar a dita Lei da Palmada. A partir da¨ª, ent o, analisar o poss¨ªvel grau de respeitabilidade da lei e como esta alteraria o cotidiano familiar. A metodologia usada para este ensaio foi o exame da norma jur¨ªdica; textos que abordam o assunto mas que n o s o, necessariamente, jur¨ªdicos; desenvolvimento de pesquisa pautada em entrevistas feitas com profissionais da educa  o e do direito e a aplica  o de question¨¢rios ¨¤ popula  o carioca. Como resultado do presente estudo formularam-se quadros de an¨¢lise do entendimento populacional do assunto e seu grau de aceita  o, bem como poss¨ªvel respeitabilidade.
