%X O presente trabalho tem por finalidade tra ar apontamentos acerca da compatibilidade entre as inova  es trazidas pela Lei no 11.705/08 ao C¨®digo de Transito Brasileiro e as garantias processuais presentes na Constitui  o Federal. ainda que haja not¨®ria importancia social, sobretudo no que tange ¨¤ diminui  o dos acidentes de transito, resta razo¨¢vel delimitar em que medida tal pol¨ªtica p¨²blica preserva as garantias constitucionais dos condutores de ve¨ªculos parados pela blitzen da Lei Seca, especialmente em rela  o ¨¤ utiliza  o do etil metro enquanto meio de aferi  o da alcoolemia do motorista. The present essay has the objective to point out the compatibility of the innovations brought by the Law no 11.705/2008 to the Brazilian Traffic Code and the process guarantees present in the Federal Constitution. Even tough there is a clear social relevance, mainly aiming at reducing the traffic accidents, it is reasonable to question until what point the measure preserves the constitutional guarantees of the drivers of vehicles stopped by Lei Seca [Anti-DUI Law] Blitzes, specially relating to the use of the breathalyser as method for measuring the BAC [Blood Alcohol Content] of the driver.
