%X La primera parte del trabajo es un an芍lisis dogm芍tico del llamado "derecho real de herencia", en el que se vierte la opini車n de la autora respecto de la abstracci車n de esta figura y de su escasa utilidad para resolver asuntos pr芍cticos como la petici車n de herencia y la cesi車n de derechos hereditarios. En la segunda parte se estudia, sobre la base de la legislaci車n vigente relativa a la cesi車n de derechos hereditarios, la naturaleza de esta instituci車n, as赤 como la forma de realizar la cesi車n cuando en ella quedan comprendidos bienes inmuebles. The first part of this paper is a theoretical examination of the so called in rem right on inheritance ("derecho real de herencia") in which the author considers this legal construct as abstract and scarcely useful when applied to solving practical matters such as legal claims to receive part of an estate and the assignment or transfer of rights in an estate. In the second part the author examines, by attending to current law on transfer of inheritance rights, the fundamentals of this institution, and also the transfer procedure when real property is part of the estate.
