%X Con las sigla A.D.R. (Alternative Dispute Resolution) se designa a todas las v赤as privadas que intentan sustituir al proceso y, por ende, a la Jurisdicci車n, como instancia p迆blica de resoluci車n de los conflictos de relevancia jur赤dica. Su auge y promoci車n que en los 迆ltimos a os se ha podido observar tanto a nivel de un sector de la doctrina como de algunos ordenamientos jur赤dicos, se debe a tres principales razones que son analizadas cr赤ticamente en este trabajo por su autor. La primera dice relaci車n con la denominada crisis de la Justicia, especialmente representada por su excesiva lentitud y atraso en dar respuesta a las solicitudes de tutela; la segunda raz車n se refiere a la necesidad de sustituir el tradicional recurso a la justicia contenciosa por una nueva justicia, de tipo conciliadora o coexistencial; la tercera raz車n dice relaci車n con su utilizaci車n para dar a tutela adecuada a determinados bienes o derechos en conflicto a los cuales la tutela estatal siempre les ha sido esquiva. Alternative Dispute Resolution or A.D.R. refers to all private proceedings that attempt to substitute the process and, thus, the Jurisdiction as a public instance for the resolution of legal disputes. Its importance and promotion, observed both in a sector of the doctrine and certain legal systems, is mainly due to three reasons that are critically analysed by the author in this paper. The first reason relates to the crisis of Justice, especially represented by the excessive slowness and delay in responding to the legal actions submitted in order to require the protection of rights. The second reason refers to the need to substitute the traditional tendency to recourse to litigation or contentious justice for a conciliatory or co-existential justice. And finally, the third reason relates to its use to provide adequate protection to certain rights in conflict, which have always been neglected by the State protection.
