%X In this paper, a Shafi¡¯i jurist and an influential political figure lived in eleventh century, Mawardi¡¯s thoughts on how the relation of religion and state had to be done, has been examined. Generated ideas in this century that religion-state relations have lived a big diffraction, Mawardi has searched for solutions to problems of his time, by thoughts he has suggested. Although his thoughts have not been put into practice, he has influenced subsequent periods and he has been accepted as reference through long ages in discussions about the Caliphate.
