%X Este artigo visa a analisar a evolu  o do constitucionalismo desde o seu surgimento at¨¦ a atualidade, dentro do que se convencionou chamar de neoconstitucionalismo. Dentro desse contexto, ¨¦ feita uma abordagem acerca da democracia e de sua repercuss o no constitucionalismo,  bem como os efeitos provocados pelo constitucionalismo transformador em uma sociedade rec¨¦m-democratizada como a sul-africana, sinalizando aspectos da transi  o, da promulga  o da Carta e da posi  o que vem sendo adotada pela corte constitucional desse pa¨ªs para a defesa dos direitos fundamentais de uma sociedade que n o perdeu as esperan as de ter, n o apenas o reconhecimento dos seus direitos civis e pol¨ªticos, mas tamb¨¦m a efetividade dos seus direitos socioecon micos de forma plena. PALAVRAS-CHAVE: Constitucionalismo. ¨¢frica do Sul. Democracia. ABSTRACT: This paper aims to analyze the constitutionalism evolution between its conception and now, within the so-called neoconstitutionalism. Within this context, was made an investigation about the impact of democracy on constitutionalism and the effects caused by a transformative constitutionalism in a freshly democratized society like South Africa. Aspects of its transition, the promulgation of the Charter and the position that has been adopted by the Constitutional Court to defend the society¡¯s fundamental rights are seen. The South African society did not lose hope of having not only the recognition of their civil and political rights, but also, their socio-economic rights. KEYWORDS: Constitutionalism. South Africa.
