ABSTRACT: This essay, inspired by the book "Incognito, the Secret Life of the Brain," discusses the legal consequences of scientific discoveries in the field of neuroscience. Treats, initially, about the concepts of consciousness (central element of guilt), passes through the theory of punishment, and deals too with forced interventions in the human brain, the nightmares of the past experiences, the constitutional limits and future possibilities.
