%X O presente artigo busca delinear o conte迆do do direito 角 assist那ncia social no ordenamento jur赤dico brasileiro. Examina a origem e o desenvolvimento hist車rico da assist那ncia social como direito no Brasil, assim como as principais pol赤ticas p迆blicas implementadas ou modificadas pelo legislador sobre o tema. Defende a fundamentalidade desse direito, relacionando-o 角 teoria geral dos direitos fundamentais sociais, e inserindo-o no contexto espec赤fico que demarca tais direitos. Segue analisando os institutos que o circundam 每 tais como os conceitos de m赤nimo existencial, n迆cleo essencial dos direitos e proibi  o do retrocesso 每, como modo de verificar eventuais transgress es, limita  es ou obriga  es de atua  o do Poder P迆blico em sua configura  o e concretiza  o. Finaliza apreciando quest es pr芍ticas atinentes a altera  es da legisla  o sobre assist那ncia social, em especial quanto 角s limita  es que devem ser observadas pelo legislador ordin芍rio para que n o destitua de conte迆do esse direito fundamental social. ABSTRACT: This article aims to outline the content of the right to social assistance in the Brazilian legal system, giving the theme a related approach to the general theory of fundamental social rights, including it in the specific context that marks such rights and relating it to the institutes that develop, such as the concepts of existential minimum, essential core rights and prohibition of retrogression. To examine the specific content of the right to social assistance, as well as make it possible to understand the analysis that intends to undertake, should be scrutinized the origin and historical development of social assistance as a right in Brazil, as well as analyzed the main public policies implemented or modified by the legislature on the subject, so as to check any transgressions, limitations or obligations of the government acting in the configuration and implementation of this important fundamental right.
