%X O objetivo deste artigo ¨¦ demonstrar que os postulados e os princ¨ªpiosinstitu¨ªdos ao longo da trajet¨®ria hist¨®rica das culturas jur¨ªdicas ocidentais alicer aram o debate dos operadores jur¨ªdicos que participaram ativamente do processo de formula  o e de implanta  o do ordenamento jur¨ªdico-penal de 1940 no Brasil. Com isso, estamosempreendendo uma reflex o sobre os efeitos de longa dura  o das realidades hist¨®ricas passadas sobre as constru  es culturais no tempo presente. The purpose of this article is to demonstrate that the postulates and principles instituted throughout Western juridical cultures throughouthistory, served as basis of debate for the juridical operators which were inherent to the formation and implementation of the juridical-penal order instituted in Brazil in 1940. Long-term effects that past historical realities still exercise on present cultural constructions are also investigated.
