%X Two hundred years of colonial rule left Latin America in a state of institutional development characterized by the tension between law and culture. Taking historical and neo-institucional perspectives, this paper discusses the gap between traditional behaviors and those imposed through legal order by the rulers of the country, which are not necessarily the most adequate ones. The author examines eleven Latin American novels so as to better understand formal and informal institutions of three critical phases of institutional development in Latin America. Doscientos a os de orden colonial marcaron en Latinoam¨¦rica una pauta de desarrollo institucional caracterizado por la tensi¨®n entre ley y cultura. Desde una perspectiva hist¨®rica y neoinstitucionalista, se describe la distancia que hay entre los comportamientos tradicionales, propios del modo como se cre¨® el orden social, y el orden legal  impuesto  por gobernantes que no siempre corresponde de modo adecuado a la sociedad que pretende regular. El art¨ªculo explora once novelas del corpus de la literatura hispanoamericana y desde all¨ª analiza las instituciones formales e informales que se revelan en tres fases cr¨ªticas del desarrollo institucional de Am¨¦rica Latina.
