%X Los establecimientos de salud tienen a su cargo la prevenci車n y control de las infecciones intrahospitalarias. La tendencia de la jurisprudencia chilena ha sido proclive a indemnizar los da os ocasionados por este tipo de infecciones. Aunque se condene civilmente al establecimiento, en general no se lo hace a trav谷s de la instauraci車n de una responsabilidad objetiva -aunque incluso err車neamente se le denomine as赤- sino mediante otros mecanismos jur赤dicos que benefician a la v赤ctima y la favorecen en definitiva judicialmente, como un entendimiento objetivo de la culpa, el establecimiento de presunciones de culpa y relaci車n causal, la invocaci車n de la culpa infraccional o los criterios jur赤dicos res ipsa loquitur y prima facie. El da o no basta. Si jur赤dicamente no se establece de alg迆n modo la culpa y la relaci車n causal la v赤ctima deber芍 soportar sus propios da os. The Health Institutions are in charge of prevention and control of the Nosocomial Infections. The tendency of the Chilean jurisprudence has been to compensate damages caused by this kind of infections. Even though the Health Establishment might be condemned by a civil action, in general the rulings are not founded in strict liability standard -even if erroneously under that name- but by means of others judicial reasoning which benefit the victim and produce the same result, like an objective understanding of negligence, the establishing of presumptions of fault and cause-effect relationship, the breach of duty or the legal criteria res ipsa loquitur and prima facie evidence. To prove damages is not enough. If negligence or the cause-effect relationship between the illicit act or omission and the damages are not legally established or proved, the victim must bear his or her its own damages.
