%X La sentencia de la Corte Suprema de los Estados Unidos de Norteam谷rica en Graham v. Florida prohibi車 la aplicaci車n de la pena de reclusi車n perpetua sin posibilidad de libertad a delincuentes menores de dieciocho a os de edad por delitos diversos del homicidio, consider芍ndola incompatible con la Octava Enmienda. Para llegar a esta decisi車n, la Corte cre車 una regla categorial, antes solo aplicada en casos de pena de muerte. Si bien los autores concuerdan en la falta de proporcionalidad de la condena impuesta al acusado, el uso de una regla categorial es criticada, consider芍ndose preferible el examen circunstanciado de proporcionalidad restringida. The United States Supreme Court decision in Graham v. Florida forbade life imprisonment without the possibility of parole for offenders under 18 years old for non-homicidal crimes, considering it as incompatible with the Eight Amendment. In order to reach this decision, the Court created a categorical rule, previously applied only to death penalty cases. Although the authors agree on the lack of proportionality of the punishment imposed on the defendant, the use of a categorical rule is criticized, considering preferable the case-to-case narrow proportionality approach.
