Competencias auton¨®micas y locales en materia de r¨¦gimen disciplinario %A Vicen£¿ Aguado Cudol¨¤ %J Revista Catalana de Dret P¨²blic %D 2012 %I Escola d'Administraci¨® P¨²blica de Catalunya %X Davant la configuraci¨® tradicional del r¨¨gim disciplinari com una manifestaci¨® del principi de jerarquia i d¡¯una relaci¨® de subjecci¨® especial, s¡¯est¨¤ obrint pas un nou sistema basat en l¡¯exist¨¨ncia de codis de conducta i d¡¯uns deures, articulat entorn de l¡¯¨¨tica i la responsabilitat dels empleats p¨²blics. Aquest sistema pret¨¦n garantir el dret dels ciutadans a la bona administraci¨® i al correcte exercici de les funcions p¨²bliques, i respectar alhora les garanties dels empleats p¨²blics. La codificaci¨® dels deures pot ser un instrument que orienti l¡¯aplicaci¨® de les sancions disciplin¨¤ries en aquells casos en qu¨¨ siguin procedents. El dret administratiu sancionador esdev¨¦ un punt de refer¨¨ncia en l¡¯aplicaci¨® del r¨¨gim disciplinari garantint la posici¨® de l¡¯empleat p¨²blic, per¨° el sistema tamb¨¦ requereix instruments ¨¤gils i efectius per assegurar el bon funcionament de l¡¯organitzaci¨® i dels serveis que presta, aix¨ª com per transmetre confian a als ciutadans envers les seves institucions i els seus servidors p¨²blics. Per aquest motiu caldria una reformulaci¨® del r¨¨gim disciplinari dels empleats p¨²blics per aconseguir un equilibri adequat entre aquests objectius. En la configuraci¨® d¡¯aquest sistema, es defensa que les comunitats aut¨°nomes i els governs locals han de tenir un paper rellevant desplegant i aplicant el sistema dissenyat per la legislaci¨® b¨¤sica estatal. In contrast to the traditional configuration of disciplinary regulations as a manifestation of the principle of hierarchy and specific subordination, a new system based on the existence of codes of behavior and some duties, articulated around ethics and the responsibility of public employees, is taking shape. This system aims at guaranteeing the right of the citizenry to good public administration and a proper operation of the civil service, while at the same time respecting the guarantees afforded public employees. The codification of duties may be an instrument that serves to orient the imposition of disciplinary sanctions where appropriate. Sanctions under administrative law become a point of reference for the enforcement of disciplinary regulations, guaranteeing the position of public employees. The system, however, also requires dynamic, effective instruments to ensure the proper functioning of the organization and the services it provides, as well as to instill trust in the citizenry regarding their institutions and their public servants. A reformulation of disciplinary regulations governing public employees would thus be necessary to achieve a proper balance between these objectives.
