%X this article analyzes the jurisprudence of the constitutional court and the chilean doctrine on the interpretation of article 83, sub-paragraph 2, cpol, and the scope given to said article, which equally grants the exercise of the criminal action to the offended parties. this work shows a critical position regarding the attempts to see in this norm a fundamental right of legal protection in the interest of victims of a certain crime. a comparative analysis regarding the situation of the victims and the legal action in the spanish and italian law is also carried out.
