%X this article addresses the analysis of the exception of the consensualism and freedom of form principles established in the "vienna convention" of 1980, drawn up by chile according to articles 12 and 96 of the same convention. its purpose is to specify the correct sense and scope ascribable to this exception and, also, to make some criticism about the way this has been interpreted by the chilean doctrine and jurisprudence.
