Hukuki bir kural olarak ¡°sakite bir s z isnat olunmaz.¡± Ancak kimi durumlarda sessiz kalma, ki inin niyetini ortaya koyar. Bu nedenle beyana ihtiya  duyulan yerlerde s¨¹k ta bir anlam y¨¹klenir. Susma, konu ma ve yap lan i lemi onaylama olarak kabul edilir. Burada, ki inin durumu ile  rf ve adet etkendir.  stisna olarak kabul edilen bu konularda hukuki i lemlerde kolayl k, ki ilerin menfaatini koruma ve muhtemel bir zarara engel olma ama lan r.In Islamic law, legality of contracts is based on consent. Person usually states his statement of condition by talking. According to principle of Islamic law ¡°a word is not attributable to the silent.¡± But, in some situation, silence present intention of men. Therefore, ascribe a meaning to this attitude. Silence accepted talking and ratification of procedure. State of people and customs is effective in this situation.
