%X This work intends to analyze the importance of the protection to national ecosystems as conditio sine qua non for the conservation of the national biological diversity. Of the theoretical analysis of the subject, starting of the legal concepts conferred its nomenclature-key (biological diversity, ecosystems and conservation), it is arrived a boarding of the Brazilian ambient legislation, with prominence to the Forest Code, in intention to inside verify the effectiveness of the rule of law of this process. Will it be the legislation capable to protect ecosystems and, thus, to guarantee the conservation of the biological diversity in Brazil? In face of the amplitude of the subject and the national wealth of biomas (forests   Mata Atlantica and Amaz nia  , hedge, scrub savanna, etc), the subject will be focused under the point of view of the conservation the national forests, opposing its necessities to the protection that the national legislation excuses to them, observing the Forest Code (Law n 4,771, of 15 of September of 1995).
