%X O objetivo deste artigo ¨¦ apresentaruma vis o cr¨ªtica da Filosofia do Direito Internacionalde Habermas. Tamb¨¦m partindo, talcomo ele, de uma base kantiana, analisar-se-¨¢alguns aspectos basilares da teoria habermasiana:o seu debate com o jurista alem oCarl Schmitt (1); a sua formula  o do DireitoCosmopolita (2) e a fraca fundamenta  o queele d¨¢ aos Direitos Humanos (3). Ent o mostrar-se-¨¢ que a sua Filosofia do Direito Internacional,apesar de estruturar fortemente asinstitui  es globais do futuro, ¨¦ algo inapropriadapara resolver problemas internacionaiscontemporaneos como o das interven  eshumanit¨¢rias.Abstract: The objective of this article is topresent a critical view of Habermas¡¯Philosophy of International Law. Starting, justas him, from a Kantian basis, a few basicaspects of Habermas¡¯ theory will be analyzed,such as his debate with German jurist CarlSchmitt (1), his formulation of CosmopolitanLaw (2) and the weak importance he gives toHuman Right (3). From then on it will beshown that his Philosophy of InternationalLaw, despite its role in the structuring of futureglobal institutions, is somewhat inappropriateto resolve contemporary international issues,such as those related to humanitarianintervention.
