%X O presente texto aborda a separa  o e a rela  o entre a filosofia do direito e a teoria jur¨ªdica na obra ¡°Direito e Democracia¡± de J¨¹rgen Habermas. Para tal an¨¢lise, busca-se num primeiro momento refletir sobre os conceitos de sociologia do direito e filosofia da justi a a partir do di¨¢logo que Habermas op e com Dworkin e Rawls, acerca do fundamento filos¨®fico da igualdade e da distribui  o. Posteriormente, analisa-se a argumenta  o acerca da fun  o social integradora do direito que Habermas desenvolve a partir das obras de Parsons e Weber, com vistas a visualizar o que Habermas entende por fun  o integradora do direito, bem como a contribui  o dessa categoria para uma teoria reconstrutiva da sociedade. Conclui-se pela vincula  o entre sua filosofia do direito a uma teoria sociol¨®gica, quando a partir do conceito de raz o comunicativa, escapando da discuss o metaf¨ªsica do absoluto, busca desenvolver um conceito de sociedade que resista ¨¤s dimens es do mundo da vida e do sistema. This text examines the distinction and relation between legal philosophy and legal theory in the book Law and Democracy by J¨¹rgen Habermas. To that end, I seek at first to reflect on the concepts of law sociology and philosophy of justice from the dialogue that opposes Habermas to Dworkin and Rawls, on the philosophical basis of equality and distribution. Subsequently, we analyse the arguments about the social integrative function of law that Habermas develops from the works of Parsons and Weber, in order to see what Habermas meant by integrative function of law as well as the contribution of that category for a reconstructive theory of the society. The conclusion points to the link between his philosophy of right to a sociological theory, when, through the concept of communicative reason, he eschews metaphysical discussions of the absolute and seeks to develop a concept of society capable of resisting the dimensions of the life world and system.
