O presente trabalho tem como objetivo discutir se tais direitos poderiam ser flexibilizados por meio de t¨¦cnica da pondera  o de valores balizada pela proporcionalidade. Para tanto, pretende-se expor uma breve explica  o sobre os direitos fundamentais, embora n o se pretenda esgotar no presente estudo as discuss es doutrin¨¢rias e jurisprudenciais sobre estes. ABSTRACT: The Discursive Theory of Law developed by J¨¹rgen Habermas consists in a participatory proposal in the construction of judicial decisions. This decision should result from a debate between those who are affected by it, under penalty of illegitimacy. To this end, Habermas advocates a minimum baseline of Fundamental Rights which provides equal participation. This paper aims to discuss whether such rights could be relaxed by the technique of balance buoyed by proportionality. To this end, this paper intend to expose a brief explanation of the Fundamental Rights, although is not intended to exhaust in the present study the doctrinal and jurisprudential discussions about them. As a result it is expected to expose the risks of the flexibility of Fundamental Rights in the balance for the supremacy of the Constitution. KEYWORDS: Fundamental Rights. Discursive Theory of Law.
