%X Este artigo examina o papel da mobiliza  o dos direitos humanos na constru  o da mem¨®ria da ditadura no Brasil, baseando se no caso da Guerrilha do Araguaia, iniciado nos tribunais nacionais em 1982 e encaminhado ¨¤ Comiss o Interamericana de Direitos Humanos em 1995 e ¨¤ Corte Interamericana de Direitos Humanos em 2009. Travando se um di¨¢logo cr¨ªtico com a literatura sobre ¡°justi a de transi  o¡±, a an¨¢lise do caso revela que n o apenas o Estado como tamb¨¦m organiza  es n o governamentais e a  es judiciais de natureza civil desempenham um papel relevante nos processos de constitui  o de mem¨®rias pol¨ªticas. A atua  o do Estado ¨¦, por sua vez, mais contradit¨®ria do que esta literatura tende a sugerir. A trajet¨®ria judicial do caso reflete, por fim, um percurso longo por¨¦m dinamico, no qual o objeto da disputa vai mudando e adquirindo novos significados e os pr¨®prios peticion¨¢rios v o se alterando, consoante as escalas da disputa e os contextos nacionais e internacionais em que se desenvolvem os conflitos em torno da constru  o da mem¨®ria da ditadura. This article examines the role of the mobilisation of human rights in constructing the memory of the dictatorship in Brazil, based on the Araguaia Guerrilla case, brought before the national courts in 1982 and forwarded to the Inter-American Commission on Human Rights in 1995 and the Inter-American Court of Human Rights in 2009. Entering into a critical dialogue with literature on ¡°transitional justice¡±, an analysis of the case reveals that, not only the state but also non-government organisations and civil proceedings, play a significant role in the processes of creating political memories. For their part, the actions of the state are more contradictory than this literature tends to suggest. Finally, the judicial trajectory of the case reflects a long, though dynamic, journey in which the object of the dispute changes and acquires new meanings, and the petitioners themselves alter according the scales of the dispute and the national and international contexts in which conflicts unfold around the construction of the memory of the dictatorship. Cet article se penche sur le r le de la mobilisation des droits humains dans la construction de la m¨¦moire de la dictature au Br¨¦sil, en se basant sur le cas de la Gu¨¦rilla du Araguaia, qui fut soumis aux tribunaux br¨¦siliens en 1982 et conduit devant la Commission Interam¨¦ricaine des Droits Humains en 1995, puis devant la Cour Interam¨¦ricaine des Droits Humains en 2009.
